I. General provision

  1. The online shop available at https://www.isprzet.pl/, which is later mentioned as „online shop” is operated by TEAMTOOLS sp. z o.o. (Limited Liability Company) with its registered office in Bielsko-Biała, Gen. Mieczysława Boruty-Spiechowicza 68 street, 43-300 Bielsko-Biała, Poland entered into the companies register of the National Court Register under the KRS number: 0001011053, holding the tax identification number (NIP) PL9372748981, and statistical number REGON: 524048403. +48 58 526 14 36, bok@isprzet.pl.

  3. These Terms and Conditions specify the rules of using the Online Shop, in particular, the rules of concluding sale agreements for products offered by isprzet.pl through the Online Shop, and of complaint procedures. It concerns both the customer and the seller.
  4. These Terms and Conditions are also available in Polish language version at https://www.isprzet.pl/.
  5. Customers are obliged not to violate any proprietary copyrights or rights of registration, patents, trademarks, utility models or industrial design.
  6. Online Store owner makes every effort to ensure the protection of personal information provided when you use the Site or make purchases within the store. The privacy policy is stated in the Terms & Conditions and is made available while placing an order or send along every time with the order confirmation.

II. Definitions

The following terms used in these Terms and Conditions have the following meaning:

  1. Online shop – the online shop (distant selling) available at  https://www.isprzet.pl/
  2. The owner (seller) - TEAMTOOLS sp. z o.o. (Limited Liability Company) with its registered office in Bielsko-Biała, Gen. Mieczysława Boruty-Spiechowicza 68 street, 43-300 Bielsko-Biała, Poland entered into the companies register of the National Court Register under the KRS number: 0001011053, holding the tax identification number (NIP) PL9372748981, and statistical number REGON: 524048403.  Phone number; +48 58 526 14 36, Email adress: bok@isprzet.pl.
  3. A customer – Anyone placing an order in the online shop in accordance with the Terms and Conditions, both a natural person and a legal entity.
  4. User - any Internet user who is visiting the online shop.
  5. User account – a field containing the data concerning all the transactions and an instrument that serves for completing customers order.
  6. Newsletter – service provided by the online shop to customers, only if they agreed. It works by sending information about online shop activities but only if the user freely submitted his email address/name and surname.
  7. Consumer - a Customer, who is at least 18 years old and with full legal capacity, performs a legal transaction with isprzet.pl not related to its business (commercial) or professional activity, in particular who makes an order in the Online Shop.
  8. Entrepreneur – a natural person, a legal person or an organizational unit not having legal personality, acting on his own behalf in his commercial or professional capacity.
  9. Working days – Monday to Friday, except for public holidays.
  10. Terms and conditions – the present document, stating terms and conditions of using online shop and placing orders.
  11. Registration – the customer freely submits personal data by filling in the form available in the online shop. 
  12. Dropshipping – the service dedicated to Entrepreneurs, based on sending products directly to their customers via https://www.isprzet.pl/
  13. Simplified Registration Procedures – data, freely submitted by the Customer, downloaded after his approval via proxy services e.g. facebook.com
  14. Proxy service – a website, where a Customer has already registered approving at the same time to data collection in order to register and using online store.

III. Technical terms of using the Online Shop

  1. To use the Online shop and place orders, the following minimum technical requirements must be met:
    • digital device;
    • access to the Internet;
    • an active e-mail account (e-mail).
  2. The online shop uses cookies i.e. small text numeric files. Their main purpose is to facilitate the use of the website, by customizing the website to the needs and expectations of the user, and analysing the movement of users within the website. Cookies are used with the consent of the user. Compliance may be expressed by the user through appropriate software settings and it can be changed any time.
  3. The online shop informs that the website user may also at any time limit or disable cookies in his/her browser but it may happen that the use of the website will be less efficient.
  4. Details regarding Cookies can be found in the Cookies policy section, which is available at https://www.isprzet.pl/ and constitute a part of a present document.

IV. Registration and Logging in

  1. In order to create  'user account' a customer needs to register by submitting an email address and a password via the registration form.
  2. A password can consist of letters, numbers or/and special characters. The password is personalized. The password can be changed by submitting email address and a new password.
  3. Registration is free of charge.
  4. Registration is not the condition of placing an order in an online shop. The conditions of placing an order are stated in point IV section 9 of the present document.
  5. Customer is obliged to provide only valid data.
  6. The customers who approve these Terms and Conditions, therefore, states that:
    • he voluntarily uses online shop;
    • the information contained in the form is correct.
  7. The customer cannot pass the password to the third party.
  8. A registered customer has the ability to: 
    • access the order status and order history;
    • receive individual discounts and vouchers;
    • obtain information about special offers and contests;
    • order products;
    • modify personal data;
    • change the password;
    • check his/her order;
  9. The orders can also be placed without registration via:
  10. The customer who takes advantage of the selling methods mentioned in point 9 i.e he will purchase the goods without the registration is obliged to approve these Terms and Conditions sent via mail.
  11. Completing the registration enables logging in.
  12. The customer is not allowed to copy, modify or distribute the content, except with written permission of the entitled person.
  13. Both the customer, who placed an order as mentioned in point 9 and registered in a shop receives information about the order status.

V. Simplified registration procedures.

  1. The customer has the ability to register via proxy services. 
  2. Registration process via Facebook is possible by choosing the ‘Facebook’ button on the https://www.isprzet.pl/ website.
  3. After using simplified registration procedures( including the consent to these Terms and Conditions and to processing of the customer’s personal data provided by the proxy services) the online shop receives the information as follows:
    • public profile;
    • email address.
  4. The customer using simplified registration procedures has the same rights and responsibilities as a registered customer.
  5. The customer using proxy services is being redirected to https://www.isprzet.pl/ use services of an online shop. 

VI. Completing an order process

  1. Orders can be placed 24/7 through the website of the Online Shop, except for maintenance works.
  2. If the draft of the sales contract does not comply with the customer’s order the customer must without undue delay notify the shop by sending an email with an indication of any discrepancies. The online shop will send the correct version of the sales contract.
  3. In case of a natural person a customer is a person who is at least 18 years old and is fully capable of legal actions.
  4. A customer can place an order in the following way:
    • select the products by adding them to the cart;
    • complete the registration form;
    • select the payment mode;
    • send the order by clicking "CONFIRMATION OF PURCHASE". Clicking this button means the Customer completes the order and has an obligation to pay;
    • send confirmation order at the customer’s email address;
  5. Registered customers may track their status order.
  6. The customer undertakes to convey the correct data.
  7. The customer who takes advantage of one of the ways of placing an order mentioned in section IV point 9 should indicate the following:
    • name and number of the selected items;
    • the Customer’s name and surname;
    • exact delivery address;
    • Customer’s phone number;
    • Customer’s email address;
  8. Items available at our website might be sent directly from the manufacturers. Manufacturers deliver parcels to the courier company specified by the Shop owner. Then the online shop sends the shipping confirmation via email.

VII. Payment methods

  1. The customer can:
    • pay for the product by online transfer through the online payment system;
    • pay for the product by bank transfer;
    • pay with cash on arrival.

VIII. Prices of products

  1. Prices of products presented on the website of the Online Shop are provided in PLN and are gross prices i.e. including VAT and other taxes. Before clicking the :ADD TO CART" button, the price does not include the cost of delivery or any other charges. Shipping and payment costs are added to the ordered products. The customer is informed about additional costs e.g. related to the packaging before placing an order
  2. The final and binding price is the price indicated in the "cart" in the summary of the order at the moment when the Customer places the order through the Online Shop.
  3. When it comes to the Entrepreneur, the price of the product sent in the order confirmation is binding. Once the order confirmation is sent to the Entrepreneur, it is the moment of concluding the sale purchase agreement.
  4. Information about the total value of the order (including shipping and payment costs) is available before choosing the option "PURCHASE CONFIRMATION" and is immediately sent to the email address provided by the customer.

IX. Delivery

  1. The product ordered through the Online Shop is to be delivered to the address indicated by the Customer by the courier company (it is agreed upon with the customer on individual basis)
  2. The delivery date is determined individually with each customer in the confirmation order.
  3. The maximum delivery time in relation to the Consumer lasts up to 30 days. In case of exceeding the deadline specified in the previous sentence, the Consumer has the right to set additional time for the seller. If the goods are still not delivered, the Customer may withdraw from the contract.
  4. Products ordered through the Online Shop are delivered on working days, excluding weekends and bank holidays.
  5. The Online Shop is responsible for the risk of accidental loss or damage to the ordered goods until the Consumer receives it unless the Consumer chose a different form of delivery than the deliveries offered by the Online Shop.
  6. Courier services are insured.
  7. The customer can check the goods at the time of picking up the parcel and in case of any damage is supposed to write the report in the presence of the supplier. Writing down the protocol is not a condition for submitting a complaint or for exercising the power to withdraw from the contract.
  8. The goods are delivered in Poland, the EU, the USA and Canada.

X. The right to withdraw from the agreement

This chapter applies to Customers who are Consumers.

  1. A Consumer who concludes a distance agreement can withdraw from this agreement within 14 days without giving any reason by an explicit statement in any form. To comply with the above deadline, it is enough to send a statement before its expiry to the address TEAMTOOLS sp. z o.o. (Limited Liability Company) with its registered office in Bielsko-Biała, Gen. Mieczysława Boruty-Spiechowicza 68 street, 43-300 Bielsko-Biała, Poland or at  bok@isprzet.pl.
  2. In the event of withdrawal from a distance contract, the contract is considered invalid. What the parties have rendered is returned unchanged..A Consumer is obliged to return the product immediately, and no later than within 14 days from the date of informing isprzet.pl about withdrawing from the agreement. To keep the deadline, it is sufficient to send the product before the lapse of the 14-day period to the address: TEAMTOOLS sp. z o.o. (Limited Liability Company) with its registered office in Bielsko-Biała, Gen. Mieczysława Boruty-Spiechowicza 68 street, 43-300 Bielsko-Biała.
  3. The consumer is liable for the decrease in the value of the item as a result of using it in a way other than necessary to establish the nature, characteristics and functioning of the item.
  4. If the Consumer has chosen the method of delivery of goods other than the cheapest method of delivery offered by the entrepreneur when placing the order, the entrepreneur is not obliged to reimburse the consumer for additional costs incurred by him.
  5. The direct costs of returning the goods in connection with the exercise of the right shall be borne by the Consumer unless the Owner has agreed to bear them or did not inform the consumer about his right to withdraw from the contract. The consumer is obliged to return the goods no later than 14 days from the date on which he withdrew from the contract unless the entrepreneur suggested that he would pick up the item himself. To meet the deadline, it is enough to return the goods before its expiry.
  6. In the event of the Consumer withdrawing from the contract, the Owner will refund the price of the order within 14 days from the date of receipt of the goods. The refund will be made to the bank account indicated by the Consumer. The owner issues a written confirmation of the return of the benefit. The Seller shall refund the payment using the same method of payment as used by the Consumer unless the Consumer has expressly agreed to a different method of return, which does not entail any additional costs for him.
  7. The model statement of withdrawal from the contract can be found on the Online shop website and is attached to these regulations.
  8. The right to withdraw from a distance contract is not entitled to the Consumer in cases of:
    • benefits with properties specified by the consumer in his order or closely related to his person (e.g. individual order)
    • services whose subject matter is the subject of rapid deterioration or having a short shelf-life;
    • benefits whose subject is an item delivered in a sealed package, which after opening the packaging cannot be returned due to health protection or hygiene reasons, if the packaging was opened after delivery;
    • benefits whose subject matter are things that after delivery, due to their nature, are inseparably connected with other things;
    • benefits that are clearly tailored to the individual needs of the consumer.

XI. Consumer's right to warranty

  1. Products offered in the Online shop are covered by the seller's 24-month liability for non-compliance of the goods with the contract. There is a presumption that if the Consumer submitted a warranty to the Seller within 12 months from the delivery of the product, the defect of the product existed at the time of its release.
  2. Complaints based on the seller's liability for non-compliance of the goods with the contract may be provided e.g.:

    • by a letter to the following address: TEAMTOOLS sp. z o.o. (Limited Liability Company) with its registered office in Bielsko-Biała, Gen. Mieczysława Boruty-Spiechowicza 68 street, 43-300 Bielsko-Biała, Poland
  3. The complaint should include a detailed description of the type of non-compliance, the date of its occurrence, the Consumer's request, the order number and contact details should be specified, which will facilitate the complaint procedure.
  4. The Seller is exempt from liability under the warranty if the Consumer knew about the defect at the time the contract was concluded.
  5. The Online Shop shall consider complaints immediately, at the latest within 14 days from receipt of the complaint sent by the Customer.
  6. In the absence of information about the method of processing the complaint, within the deadline specified in point 5, the complaint shall be considered as considered in favor of the Customer.
  7. In the event of a justified complaint, the Customer may request that the product be brought into conformity with the contract, free repair or replacement of the product with a new one, price reduction or the option of withdrawal from the contract. The Online Shop will refund the equivalent of the product price to the Customer. The customer can not withdraw from the contract if the defect is irrelevant.
  8. The response to the complaint is sent to the e-mail address or correspondence address provided by the Customer.
  9. The shop issues a written confirmation of the return of the benefit.
  10. An sample complaint form can be found on the order page and is attached to these regulations. The right to the warranty is excluded to Customers who purchase as an Entrepreneur.

XII. Principles of processing customer personal data

  1. Detailed rules for the processing of personal data of Customers-natural persons are set out in the "Privacy Policy", which is an integral part of the Regulations.

XIII. Newsletter

  1. The newsletter is sent to the email address specified by the Customer, the information is sent in the form of an email. The newsletter includes, in particular, information on products offered by isprzet.pl, current promotions and other information.
  2. The customer uses the Newsletter service voluntarily.
  3. The Customer can use the information transmission service within the Newsletter by entering the e-mail address in the Newsletter field
  4. The customer will receive an email confirming the commencement of the service, along with the information: "If you want to unsubscribe from the Newsletter".
  5. The Customer may at any time opt out of the Newsletter service by submitting a cancellation via email or changing his account settings.

XIV. Dropshipping

  1. The Customer may use the Dropshipping service by:
    • Providing data in the registration form;
    • Placing an order for specific products;
    • Providing data for delivery.
  2. The administrator declares that he has received consent from his client to provide data to send the product via the Dropshipping model.
  3. The entrepreneur declares that he will deliver the goods in accordance with the content of the order which he will receive from the customer.
  4. The administrator is responsible for providing correct data for delivery and for placing an order for his customer.
  5. When the customer is a consumer, the entrepreneur is obliged to provide information on returns and complaints.
  6. Returns and complaints are considered by the Entrepreneur with whom the order has been placed on the terms set out in these Regulations.
  7. The entrepreneur is obliged to deliver the ordered goods by the Administrator to his client within a maximum of 30 days.

XV. Others

  2. The customer has the ability to read, download the regulations on his device and make printouts.
  3. Information on the possibility of using the extrajudicial method of dealing with complaints and pursuing claims and the rules of access to these procedures are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection , Provincial Inspectorates of the Trade Inspection and the following Internet addresses of the Office of Competition and Consumer Protection:

  4. Consumers can use the following non-judicial means of dealing with complaints and redressing claims:
    • Permanent amicable consumer court operating at the Trade Inspection - the opportunity to request a settlement of the dispute arising from the concluded Sales Agreement;
    • Voivodeship inspector of the Trade Inspection-the opportunity to request the initiation of mediation proceedings in an amicable matter until the dispute between the customer and the shop ends;
    • Poviat (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection (including the Consumer Federation, Association of Polish Consumers). Advice is provided by the Consumer Federation under the free consumer helpline number 800 007 707 and by the Polish Consumer Association at email porady@dlakonsumentow.pl
    • Online dispute resolution (ODR platform). An electronic link to the ODR platform is: http://ec.europa.eu/consumers/odr/
  5. If the Customer is an entrepreneur, all disputes arising from the Regulations or sales contracts will be settled amicably by the Parties through negotiation or mediation, and in the event of the parties' failure to agree - by the General Court competent for the Owner's registered office.
  6. If the Customer is an Entrepreneur, the liability under the warranty is excluded.
